Acceptance

These Terms of Service ("Terms") govern your use of the Stampy app and this website, provided by Trusted Brands UG (haftungsbeschränkt) ("we", "us", "our"). By downloading, installing or using Stampy, you agree to these Terms. If you do not agree, do not use the app.

The service

Stampy is an iPhone and iPad app that lets you take or select a photo of a postage stamp. The app analyzes the image to identify the stamp and show issue details and an estimated value, and it lets you organize identified stamps into a digital collection with folders, notes, favorites, value sorting and optional iCloud sync across your own Apple devices.

Informational use only / no warranty of accuracy

Identifications and estimated values are not guaranteed. Stampy is a research and organization tool, not a professional appraisal, authentication or certification service. Identifications may be incomplete or wrong, and estimated values are informational only — they are not guaranteed sale prices and can differ significantly from what a stamp actually sells for. For valuable, rare, altered or potentially forged stamps, you should seek independent professional expertization and appraisal before relying on any result. You use identifications and value estimates at your own risk.

Eligibility

You must be at least 16 years old to use Stampy. By using the app, you confirm that you meet this requirement. If you are below the age of majority in your country, you may use Stampy only with the involvement of a parent or guardian.

Your responsibilities & acceptable use

When using Stampy, you agree not to:

Use the app for any unlawful purpose or in violation of these Terms.
Upload or submit content that is unlawful, infringing or that you do not have the right to submit.
Reverse engineer, decompile, disassemble or attempt to extract the source code or models of the app, except to the extent this restriction is prohibited by applicable law.
Interfere with, disrupt, overload or attempt to gain unauthorized access to the service or its infrastructure.
Use automated means to access the service in a way that places an unreasonable load on it, or that circumvents its intended use.
Resell, redistribute or commercially exploit the service without our permission.

User content

You keep all rights you have in the photos and other content you submit. To provide the service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, process and transmit your submitted content to our image-analysis and hosting providers solely for the purpose of delivering identification, value estimates and collection features to you, and to maintain and improve the service. This license ends when the relevant content is deleted, except where we must retain it to comply with law. See our Privacy Policy for how we handle your data.

Purchases & subscriptions

Stampy is free to download and offers in-app purchases and subscriptions. All purchases are billed through Apple via the App Store and Apple In-App Purchase. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel a subscription in your Apple account settings on your device. Refunds are handled by Apple in accordance with the applicable Apple Media Services and App Store terms. We do not process or receive your payment card details.

Intellectual property

The Stampy app, website, branding, text, design and software are owned by us or our licensors and are protected by intellectual property laws. Except for the rights expressly granted to use the app, no rights are transferred to you. "Stampy" and our logos may not be used without our prior written permission.

Third-party services & links

Stampy relies on third-party services, including Apple's App Store, In-App Purchase and iCloud, and image-analysis and hosting providers. Your use of those services is subject to their own terms. The app and website may contain links to third-party sites that we do not control and are not responsible for.

Disclaimers of warranties

To the fullest extent permitted by applicable law, the service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including as to accuracy of identifications or value estimates, merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free or that results will be accurate or reliable.

Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill, arising out of or related to your use of the service. Nothing in these Terms excludes or limits our liability where it cannot lawfully be excluded or limited.

In particular, these Terms do not affect your mandatory statutory rights under German law, including consumer protection rights, and do not limit our liability for intent, gross negligence, injury to life, body or health, or under the German Product Liability Act (Produkthaftungsgesetz), or for the breach of essential contractual obligations where such liability is mandatory.

Indemnity

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, damages and reasonable expenses arising from your breach of these Terms or your unlawful use of the service. This does not apply where the claim results from our own fault to the extent such allocation is not permitted by mandatory law.

Termination

You may stop using Stampy at any time and remove the app from your devices. We may suspend or terminate your access if you materially breach these Terms or use the service unlawfully, subject to your mandatory rights. Provisions that by their nature should survive termination will survive.

Changes to the service & terms

We may update, change or discontinue features of the service, and we may update these Terms to reflect changes to the app, our providers or the law. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Continued use of the app after changes take effect means you accept the updated Terms.

Governing law & jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected. Where permitted by law, the courts competent for our registered seat have jurisdiction.
